Draft DCP and draft Planning Agreement for 361-365 North Rocks Road, North Rocks

Project Description

Project Update - May 2026

On 28 April 2026 Council approved the site-specific Development Control Plan and Planning Agreement for 361-365 North Rocks Road, North Rocks with the following resolution:

(a) That Council note the submissions received in response to the public exhibition of the draft DCP and draft Planning Agreement as summarised and responded to in this report and Attachment 1 for 361-365 North Rocks Road, North Rocks.

(b) That Council notes that while its position remains opposed to the Planning Proposal, the draft Planning Agreement and draft DCP are important documents to secure the delivery of local infrastructure and guide the detailed design of the proposal.

(c) That Council approve the draft Development Control Plan (DCP) provided at Attachment 2, for land at 361-365 North Rocks Road, North Rocks for insertion into Part 8 of the Parramatta DCP 2023, with the draft DCP to come into force following the Minister for Planning and Public Spaces' (Minister) determination of the Planning Proposal associated with this land.

(d) That Council enter into the draft Planning Agreement provided at Attachment 3, for land at 361-365 North Rocks Road, North Rocks, and delegates authority to the Chief Executive Officer to execute it on behalf of Council noting that Council will not be able to finalise the Planning Agreement prior to the Minister’s determination of the Planning Proposal being considered for this site, to ensure the agreement is consistent with the final Planning Proposal.

(e) That Council delegate authority to the Chief Executive Office to:

  • make amendments to the draft DCP and Planning Agreement prior to their finalisation to reflect the Planning Proposal as determined by the Minister; and
  • make minor amendments and corrections of a non-policy and administrative nature that may arise during the finalisation process relating to the draft DCP and draft Planning Agreement.

Background

The City of Parramatta Council publicly exhibited a draft Site-Specific Development Control Plan (DCP) and draft Planning Agreement for land at 361-365 North Rocks Road, North Rocks, outlined in Figure 1 below.

The draft DCP and draft Planning Agreement relate to a Planning Proposal for the site which was publicly exhibited by the Department of Planning, Housing and Infrastructure (DPHI) from 28 February 2025 to 11 April 2025. The Planning Proposal for the site proposes to increase the permitted height of buildings control and the permitted floor space ratio (FSR) control to facilitate the development and delivery of a housing precinct comprising a mix of detached housing, townhouses, low to midrise apartments, seniors housing, and community facilities. Proposed Draft Development Control Plan

The draft DCP provides additional planning and design guidelines to support the aims and objectives of the Planning Proposal. It provides detailed controls and standards for addressing development issues and will be taken into consideration in determining any development application for the site. The draft DCP provides site-specific controls relating to:

  • Spatial Structure and Built Form - controls to facilitate street layouts, building orientation, landscaping, setbacks, and building heights.
  • Public Domain -controls to facilitate public footpaths, pedestrian connections, cycle access, and community open spaces.
  • Vehicular Access and Parking – controls to facilitate vehicular access into and out of the site is safe and efficient and that an appropriate amount of parking is available.

The draft DCP cannot be inconsistent with or seek to override any of the planning controls the DPHI may seek to implement via the Planning Proposal discussed above. For this reason, the draft DCP exhibited is consistent with the Planning Proposal previously exhibited.


Draft Planning Agreement

A draft Planning Agreement which secures delivery of community infrastructure in response to the increase in density resulting from the development was also exhibited. The draft Planning Agreement provides for the following:

  • Construction of a multi-sport oval, pavilion, multipurpose courts, and play areas
  • Construction and full fit out of a multipurpose community facility in the order of 1,100m2 - 1,300m2
  • Community parking to support the oval and multipurpose centre
  • The provision of 2% of the new residential floor area as affordable housing, being approximately 16 affordable housing units, dedicated in perpetuity to Council
  • Refurbishment and dedication of existing cottage to Council to be used for community purposes
  • A monetary contribution towards the upgrade of the shared path connections to M2 Barclay Commuter Carpark, or alternatively a monetary contribution towards the embellishment of local open space
  • Easement over open space and bushland areas for public access
  • Dedication of local roads (no value has been attributed to these works)
