No, this proposal is not for a Planning Proposal.
Instead, it relates to a draft Development Control Plan (DCP) and a draft Planning Agreement.
A site-specific DCP provides detailed controls for development, tailored to the site’s needs and local context. A Planning Agreement is a legal document between developers and government agencies to deliver infrastructure or public amenities to support future development, whereas a Planning Proposal (also known as a rezoning application) seeks changes to land use controls in the Local Environmental Plan (LEP), such as building heights. (An LEP is a higher-order planning instrument that provides the key development standards.)
The draft DCP that applies to the applicant’s land only provides complementary planning controls that will enact the provisions contained in the Parramatta Local Environmental Plan 2023 (PLEP 2023) for the applicant’s land.
The Planning Proposal for this site was exhibited by the Department of Planning, Housing and Infrastructure from 28 February to 11 April 2025. For more information on the Planning Proposal, refer to the link below: Planning proposal at 361-365 North Rocks Road, North Rocks | Planning Portal - Department of Planning and Environment
No, this proposal is for a draft Development Control Plan (DCP) and draft Planning Agreement only and does not propose any change to the density.
Changes to the density were proposed via the Planning Proposal, which also proposed changes to zoning, Floor Space Ratio, and height controls, and was subject to its own assessment process and public exhibition period.
The Planning Proposal was exhibited by the Department of Planning, Housing and Infrastructure (DPHI) on 28 February 2025 and concluded on 11 April 2025.
No, this proposal is for a draft DCP and draft Planning Agreement applying to the site.
Future development of the site will require a separate Development Application to be lodged that will be separately assessed against the planning controls.
The draft DCP proposes detailed controls that will align with the new higher-order controls in the Planning Proposal that seek to amend the existing controls in the Parramatta Local Environment Plan (PLEP 2023) to enable future development of the housing precinct comprising a mix of detached housing, townhouses, low to midrise apartments, seniors housing, and community facilities. (subject to a separate Development Application assessment process).
The draft Planning Agreement will secure the provision of infrastructure, services and public amenities needed to support future development of the site.
The draft DCP cannot be inconsistent with or seek to override any of the planning controls the DPHI may seek to implement via the Planning Proposal discussed above. For this reason the draft DCP exhibited is consistent with the Planning Proposal previously exhibited.
The draft DCP and Planning Agreement only apply to the applicant’s land at 361-365 North Rocks Road, North Rocks (outlined in Figure 1 of the DCP).
The draft DCP will guide the development of the site in accordance with the amendments to the Floor Space Ratio and height controls set out in the Planning Proposal. The Planning Agreement will facilitate community benefit to future residents of the site and the wider community.
The Council approved the draft DCP to be prepared and exhibited at its meeting on 9 December 2024 and the results of the exhibition will be reported back for Council’s consideration.
The draft DCP provides site-specific development controls relating to:
-
Desired Future Character – controls to ensure a future development that reflects surrounding low-density residential character.
-
Spatial Structure and Built Form – controls to ensure the spatial structure and built form integrates with the existing environment.
-
Public Domain – controls to ensure that publicly accessible open space is suitably designed to provide high amenities.
-
Vehicular Access and Parking – controls to ensure the vehicular access into and out of the site is safely and efficiently designed and that an appropriate amount of parking is available at the subject site.
A Planning Agreement is a legal document that is created under the Environmental Planning and Assessment Act 1979 between developers and government agencies (including councils) typically to facilitate the provision of funds or works by the developer for infrastructure, services, or other public amenities.
Planning agreements are generally tailored to help contribute towards meeting the needs for increases or improvements in local services generated by the development proposed.
The draft Planning Agreement provides for the following:
-
Construction of a multi-sport oval, pavilion, multipurpose courts, and play areas.
-
Construction and fit out of a multipurpose community facility in the order of 1,100m2 - 1,300m2.
-
Community parking to support the oval and multipurpose centre.
-
The provision of 2% of the new residential floor area as affordable housing, being approximately 16 affordable housing units, dedicated in perpetuity to Council.
-
Refurbishment and dedication of existing cottage to Council to be used for community purposes.
-
A monetary contribution towards the upgrade of the shared path connections to M2 Barclay Commuter Carpark, or alternatively a monetary contribution towards the embellishment of local open space.
-
Easement over open space and bushland areas for public access.
-
Dedication of local roads (no value has been attributed to these works).
The planning proposal was exhibited by the Department Planning, Housing and Infrastructure (DPHI) from 28 February to 11 April 2025. Details are available here:
The public exhibition will take place from 4 February 2026 to 4 March 2026. Following this, all feedback will be reviewed, and a post-exhibition planning report including a summary of the submissions received during the public exhibition period will be reported to Council.
Community feedback is critical to ensuring the proposal meets local needs. All feedback received during the exhibition will be carefully considered and may lead to adjustments to the DCP and Planning Agreement.
