Draft Planning Proposal for 59-59A Belmore Street East, Oatlands

A planning proposal explains proposed changes to land use planning controls in a Local Environmental Plan (LEP). It details the proposed changes to controls and sets out the justification for why these changes are suitable for the site. 

A planning proposal can be prepared by anyone. Usually, it is prepared by a landowner, developer, or Council.
 

A Local Environmental Plan (LEP) is a legal document that guides planning decisions on specific development proposals. It is prepared by the local Council and approved by the State Government.

The LEP is an important planning tool that helps shape the future of an area and ensures development is carried out appropriately.

An LEP addresses development standards such as land use zones, building heights, heritage, and environmental protection.

The development application (DA/547/2020) approved a medical centre, gymnasium, health service facility, swim school and neighbourhood shop with 49 basement car parking spaces on the site.

DA/547/2020 was approved when Parramatta Local Environmental Plan (PLEP) 2011 was still in force and permitted indoor recreation facilities (gymnasium and swim school) in the R2 Low Density Residential zone.

In March 2023, PLEP 2023 came into effect. It replaced PLEP 2011 and prohibits indoor recreation facilities in the R2 zone. Part of this Planning Proposal is to allow for indoor recreation facilities as an additional use on the site consistent with the approved development application.
 

The Planning Proposal has been prepared to facilitate a minor increase in density within the approved building envelope and to make some additional uses (indoor recreation facilities, office premises, business premises, and food and drink premises) permissible on the site subject to the applicant receiving development consent. 

The Planning Proposal proposes to make indoor recreation facilities (maximum floor area of 1,100sqm), office premises and business premises (combined maximum floor area of 850sqm) and food and drink premises (maximum floor area of 150sqm) permissible on the site.

The applicant would still need to obtain the necessary development approvals before these uses could commence on the site. 
 

An additional permitted use is identified in Schedule 1 of the Parramatta Local Environmental Plan 2023 (PLEP 2023) and the Additional Permitted Use Map. It allows a parcel of land to be used for another use other than a use permitted in the zone identified in the land use table. 

No, the Planning Proposal seeks to allow additional floor area within the approved building footprint. The additional floor area is accommodated through design reductions to the plant space on level 1 and the enclosure of the ground floor swimming pool. This means there are no changes to the bulk and scale of the approved building as a result of the Planning Proposal.
